An unhappy shopping experience

My wife bought a small LG mini compo from Tesco Mutiara Damansara last Friday as her current mini compo ceased operation recently.

So I fixed it up last night, hoping that she will have peace of mind when working in her office.

About 30min later. She SMSed me that the compo seems having problem with the audio CD she was playing, besides music, hissing noise like you turn on radio but not locking to any station.

She was annoyed, thought that it may be the CD that is giving problem.

So I advised her to play another CD, after a short while, the hissing noise came back.

Well, it looks like the unit is overheating at the first glance. But when I touched the unit, it was cold, no heat. Further, she turned on air cond at 24C just to make sure.

"Try again tomorrow." I said. Was tired.

She mumbled at me, wanted to send the unit back to Tesco the next day. Yes, she got the same noise on different track on a different CD again.

Then we tested, turned off the unit, on again, played the problematic track, nothing happen.

Then it was hissing again on other track.

"It must be a faulty unit, better to report to Tesco before it is too late." she said.

She called Tesco customer service, and was stunned that Tesco said they are not responsible for exchange or service of Brand A and B type of products, of which LG happened to be Brand A.

She got irritated, as we were not informed when we decided to purchase the unit. Only after payment is made she was told to read a little paper clipped together with the receipt. The little piece printed is fine print that brand A and B products do not entitle for exchange or service after purchase. There is, however, not specified which is brand A or B.

She called again demanded to speak to a manager. A gentleman, Mr Mani attended the call. Although spoken softly, but he insisted that we send the unit back to LG's service centre instead.

I took over the call as she is rushing for her stories. I told him that we were not informed that Tesco discharged it's responsibilty BEFORE payment was made. I said that the piece of paper clipped behind the receipt, and we were told to read, and should we have any problem, refer to Tesco. That's all. He said that all sales specialists in Tesco must brief the customers on this, and he will query the particular sales specialist.

I then told him, if I were the sales specialist, I would insisted that I have mentioned to all customers, including my wife.

The point is: should Tesco wish to discharge its responsibilty, they would have display the notice at prominant places instead of just asking customer to read the fine print AFTER payment is made.

The only reason we bought from stores like Tesco or Jusco or Courts for all our electrical goods except computers, is because our timing is odd and these stores may attend to our problem should there be any, at wee hours.

I them told Mr Mani the following: "We demand for refund or exchange with Tesco since Tesco is the payee of the transaction. And we are sure that we were not informed, neither it was a binding terms in the sales contract, of which when we offer to buy such product, such terms did not exist. The term existed only AFTER payment is made, and was in a form of a small piece of paper, with not specific reference to the brand of product that we have purchase. This is misrepresentation, and probably void the sales contract that we entered."

I continued by demanding that he call us back today to inform us if there's a solution, ie Tesco exchanged the unit, or help us to escalate to LG.

My concious is clear. Tesco is the payee, not LG. the sales contract binds both Tesco and my wife, LG is a third party. Unless both parties agreed that all service matter refers to LG, with prior consent from LG that they will undertake the service, else the contract is simply void and we have all rights to demand for refund.

Mr Mani did not call back. And we decided to make a trip to Tesco, some 30+km away from our home.

We were looking for Mr Mani when we reached. He keeps saying that there's nothing he can do, since it is Tesco's policy. After a while he agreed that the electrical department specialist to test the unit.

We told many times that the problem does not have a clear-cut symptom, it comes at random.

When the sales specialist tested the unit, it seems alright. However, my wife recorded the hissing noise and tic-tac noise from the unit on her Samsung MP3, and we were trying to expalin that this is the audible noise when the problem hit. Mr. Mani jumped into conclusion that the unit is functioning as it is able to play our USB MP3 player. He was at first not allowing us to play the audible problem we recorded, claiming that tests must be conducted with their USB or CD. he failed to understand what traspires, and failed to address the issue at shortest possible time. Then he walked away.

After a few round explaining to the sales specialist, they agreed that they heard the noise from our playback, and then calling Mr. Mani for follow-up action.

My wife went to car parkto pick up her name card, and I was waiting at the electrical department that Mr. Mani should come anytime.

We waited for some 45minutes, hungry and thirsty. There's no sign that Mr.Mani is coming.

Then my wife told me from the entrance that Mr. Mani is at the entrance, refused to come to see us at the electrical department.

I rushed to the entrance, was not able to get Mr. Mani. My wife told me the she had s short exhcnage with Mr. Mani and he called my wife "angin".

A lady, assumed herslef to be the person in charge for customer service, Cik Ros, was attentinh to us. We met her when we were talking to Mr. Mani before sending the unit to test earlier.

She was helpful and decided to help us to deal with LG on our matter, and said will be calling us tomorrow evening.

I have stated clearly that we do not wish to have the unit repaired, since the unit is having problem in the first 2 days.

And idid mention that I will file a complaint to Tesco's management on the whole issue.

Now, we will have to wait for the outcome and deal with it tomorrow.

Who should seek Royal consent to dissolve the Perak State Assembly?

Merdeka Review's headline today claimed BN may consider dissolving the State Assembly, putting the Perak fiasco to an end.

Now, we, sorry, BN has a problem.

What problem?

Should BN's "Menteri Besar" seek Royal consent to dissolve the State Assembly? Or should the legitimate Menteri Besar at ALL MATERIAL TIME, YB Dato' Seri Nizar, as concluded by the High Court recently, dissolve the State Assembly.

Even if a Stay order is granted to defer execution of verdict by the High Court, it is undeniable that YB Dato' Seri Nizar has not, and never, relinquish his position as Menteri Besar of Perak as I concluded in my earlier post. Again, this is merely my perspective on the issue with no credible legal background, be warned.

Now we have a BN appointed, claimed "Menteri Besar", who is currently assuming the position you know why.

If BN's "Menteri Besar" seeking Royal consent to dissolve the State Assembly, is the action legitimate?

If the dissolution of the State Assembly is consented by the Sultan, but from a "Menteri Besar" who is legally not the Menteri Besar (based on the High Court ruling), should the Assembly be dissolved? Should Pakatan happily accepted the dissolution? Should the Perakian celebrate that they have win the war?

The end result may be the same, i.e. which Menteri Besar dissolves the Assembly as long as the Assembly is dissolved, but it has a negative implication, at least, that Pakatan acknowledged that BN's "Menteri Besar" is the Menteri Besar and not the legitimate Menteri Besar at all material time, YB Dato' Seri Nizar.

Should this be the ending of the whole Perak episode, I would say Pakatan is no different than BN.

Are we in economy crisis? Gee! Look at how they spent!

Are we in economy crisis?

Well, I think most of us feel the downturn of economy, at the same time, cost of living goes up pressuring almost every households in the country.

At this juncture, the State Government of Trengganu did something to stimulate the economy.

The State Government did a full page advertisement on newspaper thanking the Deputy Prime Minister cum Minister of Education for his first work visit to the state.

Walao! Full page color adv! Do you know how much does it cost? At least RM20k man!

Say if the State Government advertised on all major print media, say 10 national papers, it means atleast RM200k is spent for a thank you note!

Yes, I know, the State Government has recently received its accrued Petrol Royalty from the Federal Government, and they are rich now.

But the state is still one of the poorest states, and there are still many projects needs money to carry out.

Why spent on advertisement? Isn't it better to use the money wisely for the welfare of the people, or to the school children instead?

Yes, RM200k can't even buy a Mercedes S Class for the State Excos, but it can buy 100,000 botttles of milk for the children in the state.

What's gone wrong with the Government that cares? Don't they learn mathematics in schools?

Asparagus/Cancer - Must Read

This is an email I received from a Twitter @Hadramie, it may be useful for those who need it or wish to try out.

This is a very good article on Asparagus..known to cure Cancer.
Kindly go through the same.

Three types of asparagus on a shop display, with white asparagus at the back and green asparagus in the middle. The plant at the front is Ornithogalum pyrenaicum, is commonly called wild asparagus,

Several years ago, I had a man seeking asparagus for a friend who had cancer. He gave me a photocopied copy of an article, entitled, `Asparagus for cancer ' printed in Cancer News Journal, December 1979.

I will share it here, just as it was shared with me: ' I am a biochemist, and have specialized in the relation of diet to health for over 5 years.

Several years ago, I learned of the discovery of Richard R.Vensal, D.D.S. that asparagus might cure cancer. Since then, I have worked with him on his project. We have accumulated a number of favourable case histories. Here are a few examples:

Case No. 1,
A man with an almost hopeless case of Hodgkin ' s disease (cancer of the lymph glands) who was completely incapacitated. Within 1 year of starting the asparagus therapy, his doctors were unable to detect any signs of cancer, and he was back on a schedule of strenuous exercise.

Case No. 2,
A successful businessman 68 years old who suffered from cancer of the bladder for 16 years. After years of medical treatments, including radiation without improvement, he went on asparagus. Within 3 months, examinations revealed that his bladder tumor had disappeared and that his kidneys were normal.

Case No. 3,
A man who had lung cancer. On March 5th 1971, he was put on the operating table where they found lung cancer so widely spread that it was inoperable. The surgeon sewed him up and declared his case hopeless. On April 5th he heard about the asparagus therapy and immediately started taking it. By August, x-ray pictures revealed that all signs of the cancer had disappeared. He is back at his regular business routine. *

*Case No. 4,
A woman who was troubled for a number of years with skin cancer. She finally developed different skin cancers which were diagnosed by asking specialist as advanced. Within 3 months after starting on asparagus, her skin specialist said that her skin looked fine and no more skin lesions. This woman reported that the asparagus therapy also cured her kidney disease, which started in 1949. She had over 10 operations for kidney stones, and was receiving government disability payments for an inoperable, terminal, kidney condition. She attributes the cure of this kidney trouble entirely to the asparagus.

I was not surprised at this result, as `The elements of Material Medica ' , edited in 1854 by a Professor at the University of Pennsylvania , stated that asparagus was used as a popular remedy for kidney stones. He even referred to experiments, in 1739, on the power of asparagus in dissolving stones.

We would have other case histories but the medical establishment has interfered with our obtaining some of the records. I am therefore appealing to readers to spread this good 20news and help us to gather a large number of case histories that will overwhelm the medical skeptics about this unbelievably simple and natural remedy.. For the treatment, asparagus should be cooked before using, and therefore canned asparagus is just as good as fresh.

I have corresponded with the two leading canners of asparagus, Giant Giant and Stokely, and I am satisfied that these brands contain no pesticides or preservatives.

1) Place the cooked asparagus in a blender and liquefy t make a puree, and store in the refrigerator.

2) Give the patient 4 full tablespoons twice daily, morning and evening.

Patients usually show some improvement in from 2-4 weeks. It can be diluted with water and used as a cold or hot drink. This suggested dosage is based on present experience, but certainly larger amounts can do no harm and may be needed in some cases.

As a biochemist I am convinced of the old saying that `what cures can prevent ' . Based on this theory, my wife and I have been using asparagus puree as a beverage with our meals. We take 2 tablespoons diluted in water to suit our taste wit breakfast and with dinner. I take mine hot and my wife prefers hers cold.

For years we have made it a practice to have blood surveys taken as part of our regular checkups.

The last blood survey, taken=2 0by a medical doctor who specializes in the nutritional approach to health, showed substantial improvements in all categories over the last one, and we can attribute these improvements to nothing but the asparagus drink...

As a biochemist, I have made an extensive study of all aspects of cancer, and all of the proposed cures. As a result, I am convinced that asparagus fits in better with the latest theorie about cancer. Asparagus contains a good supply of protein called histones, which are believed to be active in controlling cell growth. For that reason, I believe asparagus can be said to contain a substance that I call cell growth normalizer. That accounts for its action on cancer and inacting as a general body tonic. In any event, regardless of theory, asparagus used as we suggest, is a harmless substance.

The FDA cannot prevent you from using it and it may do you much good.. It has been reported by the US National Cancer Institute, that asparagus is the highest tested food containing glutathione, which is considered one of the body ' s most potent anti-carcinogens and antioxidants.

When robbers lodged report that they were robbed!

When a bunch of robbers, marching to the police station, and lodged police report that they were robbed, what will the police do?

In Chinese proverb (Chinese seems to have phrases describing whatever situation, perhaps they suffered too much??) 贼喊贼抓贼。

Below is a song written by a Chinese, get it translated, don't be lazy!

抓贼抓贼 偷井盖的贼呀
抓贼抓贼 偷井盖的贼呀
抓贼抓贼 偷井盖的贼呀
抓贼抓贼 偷井盖的贼呀
抓贼抓贼 偷井盖的贼呀

Perak Menteri Besar

The Perak Fiasco has been like roller coaster, going up and down, swinging left and right, diving down from the peak and thrusting up to the sky.

Layman like me got blur with all the legal terms, definitions, legitimacy of who is really the Menteri Besar..

To teach myself a good and free legal lesson of which you probably wont have such case before, and will never have it repeated, as Chinese says "never had someone before, and there'll be no one in the future" or "前无古人、後无来者" - I translated it literally as I am poor in English (not the worst I guess, as I did not ever in my life pronounce ELECTION as ERECTION, and have it screen live on TVs worldwide).

So let's see what I learned from the past few days of Perak excitement:

1. YAB Dato' Seri Nizar was granted, or rather affirmed by the High Court that he is the legitimate Menteri Besar of Perak at all material time.

What does this mean?

This means that YAB Dato' Seri Nizar is the ONE and ONLY Menteri Besar for Perak. Of course there should not be another Menteri Besar as Perak's Constitution made it clear that there's ONLY ONE Menteri Besar.

2. ZamZam (aka Zamzam Gandhi Mandela or Zamzam Mandela Gandhi or any of the 9 combinations) filed to Court of Appeal for a "Stay Execution", meaning Zamzam is seeking the Court of Appeal to hold on to the ruling from the High Court that YAB Dato' Seri Nizar is the legitimate Menteri Besar of Perak at all material time.

Note that the ruling from High Court stated "YAB Dato' Seri Nizar is the legitimate Menteri Besar of Perak at all material time"

By doing so, Zamzam hopes that he can restrain YAB Dato' Seri Nizar from performing his duty as Menteri Besar of Perak, and the Court of Appeal duly granted a "Stay Execution" in favour to Zamzam.

Now, with "Stay Execution", Zamzam assumed that he is the Menteri Besar.

However, my pea-size brain (I picked this from one of Zamzam's legal team, look elsewhere for the answer, clue: Who exchanged the infamous SMSes with current PM back in year 2006?) tells me otherwise.

It is a "Stay Execution", meaning that it defers the High Court judgement pertaining to affirming that "YAB Dato' Seri Nizar is the legitimate Menteri Besar of Perak at all material time" - this again, my understanding of what "Stay Execution" is all about.

When further digging into Perak's Constitution, which detailed how should a Menteri Besar relinquish its position, i.e. if the Menteri Besar resign, or if the Meteri Besar dissolve the State Assembly after obtaining Royal consent.

So, should YAB Dato' Seri Nizar resigned, or obtained the Royal consent to dissolve the Assembly, then the position of Menteri Besar is vacated, then anyone, including himself, can seek for the Assembly's support to be the next Menteri Besar.

In the event where election is held, Menteri Besar should be the state assembly person nominated by the Assembly, ie secured the confidence of the majority in the Assembly.

YAB Dato' Seri Nizar did not resign, neither did he dissolved the Assembly with Royal consent, this means that he is still the legitimate Menteri Besar, with or without the High Court's ruling.

This means, Zamzam is never the Menteri Besar, as there should be not more than ONE Menteri Besar for the state of Perak.

If Zamzam is never the Menteri Besar, in what capacity he can assumed himself as the Menteri Besar after obtaining the "Stay Execution"?

The "Stay Execution" merely defer the High Court judgement, of which, with or without the judgement, YAB Dato' Seri Nizar is the Menteri Besar since he did not resign, and the Assembly is not resolved.

Even if the "Stay Execution" does have effect on YAB Dato' Seri Nizar to act as the Menteri Besar, the appropriate outcome should be:

The position of Menteri Besar is suspended temporarily pending further decision from the Courts. Whether the Courts are empowered by the Laws to suspend a Menteri Besar is yet to be tested.

If the position of Menteri Besar is suspended, naturally the next in line should assume Menteri Besar's functions until the legal matter clears, which again, cannot be Zamzam as he is not a member of the State Government.

I did come across news reporting that Zamzam & Co intended to table a motion of no confidence towards YAB Dato' Seri Nizar, as the Menteri Besar of Perak.

It is getting interesting as I read the action by Zamzam & Co as:

Zamzam & Co recognises YAB Dato' Seri Nizar as the legitimate Menteri Besar. If not, why bother to table the motion of no confidence, or if not doing, but keeping the option open is already publicly admitted that Zamzam is never the Menteri Besar.

I am getting myself a little confused with Menteri Besar here or there, now my conclusion.

As I did mention, this is not a professional findings, but merely from what I have learned the past few days, that

Zamzam is never the Menteri Besar of Perak, full stop!

Profitable business

Oh Ya! Who says our Government knows nothing about economy? Who said the Government doesn't know business? Who says the Government is bad in mathematics?

From the New Economy Policy, to the number of tourists arrival, and the inflation and unemployment rates, our Government has demonstrated its ability to administer not only the country, but numbers as well.

The recent release of 13 ISA detainees (for those who does not know what ISA is all about, here you are: ISA is short-form for Internal Security Act, which allows the Authority to detain anyone, yes, anyone on earth, for a renewable 2-year detention without trial. Detainee will be denied all rights during the detention. For more information, refer to Wikipedia) and the earlier release of 13 detainees is a good example where:

1. in the first place, there should be no ISA detainees. Any suspect shall appear in front of the public court, and to have their rights to defense.

ISA denied their rights to defend. By release them is just like I take something in hand, when needed, I let go to achieve my goal. Kind of chip in hand;

2. By releasing 26 detainees, the Government arrested some 116 civilian, including opposition politicians, and 5 Legal Aids Centre lawyers who offered legal assistance to the other detainees;

the mathematics:

116 newly arrested, 26 released. There are still surplus of 90.

conclusion: our Government is good in mathematics, it is proven, and it is true.

My advise: do not undermine the mathematically minded Government as we may lose more..
